Shuster Will Vote to Protect Private Property Rights

Citizens Can Go to Federal Court if Government Tries to Seize Property

Washington, DC – Congressman Bill Shuster strongly supports a bill protecting private property rights and plans to vote in favor of the bill Tuesday. The House of Representatives considered the Private Property Implementation Act (H.R. 4772) today, which would enable property owners to take their lawsuits directly to federal court and skip over the state court system.

“Private property is an important part of the American dream,” said Shuster. “The government should not be allowed to take someone’s property away from them without a fight. A citizen should never have to surrender their land to the government without the full protection of the law. The burden must be on the government to prove why there are absolutely no other options before they are permitted to take the property someone has worked their entire life for.”

Eminent domain refers to the government’s ability to seize private property for federal or state projects. The measure would protect private property owners and allow them to appeal the government’s decision to seize their property in federal court, instead of starting in the lower, more easily disputed state and local courts.
