U.S. Congressman Marchant and City of Carrollton Joint Press Release CARROLLTON -- Through the efforts of U.S. Congressman Kenny Marchant, the City of Carrollton has formalized its participation in the 287(g) program by entering into a Memorandum of Agreement with Immigration and Customs Enforcement (ICE). This MOA outlines relationship between the City and ICE and authorizes the City to participate in the 287(g) program. Section 287(g) of the Illegal Immigration Reform and Immigration Responsibility Act (IIRAIRA) authorizes the secretary of the U.S. Department of Homeland Security (DHS) to enter into agreements with state and local law enforcement agencies, permitting designated officers to perform immigration law enforcement functions, pursuant to a Memorandum of Agreement (MOA), providing that these officers receive appropriate training and function under the supervision of sworn ICE officers. City of Carrollton Mayor Ronald F. Branson said, “We are very pleased that this MOA has been formalized. It gives us another tool to help assist the federal government in enforcing federal immigration laws.” Carrollton City Manager Leonard Martin said, “This is a jail program. This program will only be used if someone is arrested on criminal charges. If there is probable cause to suspect that arrested person is not in the country legally, then our 287(g) trained officers will be able to access additional databases to determine if ICE has a hold on that person. If the person is determined to have a detainer notice to be held for ICE or if it is determined the person is in the country illegally, ICE will work with our staff to determine the appropriate immediate pre-adjudication disposition of the person.” The City Council has authorized the City to hire two additional jailers who will receive extensive ICE training and will be trained in 287(g). Martin said, “We appreciate Congressman Marchant's commitment to enhancing our law enforcement capabilities.” ### |
